1. Agreement to Terms
By accessing or using QuickMenu ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
QuickMenu is a software-as-a-service platform that enables restaurants and food establishments to create and manage digital menus accessible via QR codes. The Service includes menu management tools, QR code generation, and analytics features.
3. Accounts
3.1 Account Creation
To use certain features of the Service, you must register for an account. You must provide accurate, current, and complete information during registration and keep your account information updated.
3.2 Account Security
You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
3.3 Account Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent that you meet these requirements.
4. Subscription and Payment
4.1 Free and Paid Plans
QuickMenu offers both free and paid subscription plans. Feature availability varies by plan. We reserve the right to modify plan features with reasonable notice.
4.2 Billing
Paid subscriptions are billed in advance on a monthly basis. Payment is processed through Stripe. You authorize us to charge your payment method for all fees incurred.
4.3 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial months.
4.4 Price Changes
We may change subscription prices with 30 days notice. Price changes will apply to the next billing cycle after the notice period.
5. User Content
5.1 Your Content
You retain ownership of all content you upload to the Service, including menu items, descriptions, images, and restaurant information ("User Content").
5.2 License to Us
By uploading User Content, you grant QuickMenu a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing the Service.
5.3 Content Responsibilities
You are solely responsible for your User Content. You represent that:
- You own or have the right to use all content you upload
- Your content does not infringe on any third-party rights
- Your content is accurate (especially regarding allergens and ingredients)
- Your content complies with all applicable laws
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload false, misleading, or deceptive content
- Upload content that is harmful, offensive, or violates third-party rights
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Resell or redistribute the Service without authorization
7. Intellectual Property
The Service, including its original content (excluding User Content), features, and functionality, is owned by QuickMenu and protected by copyright, trademark, and other intellectual property laws.
Our trademarks may not be used without prior written consent. You are granted a limited, non-exclusive license to use the Service for its intended purpose.
8. Third-Party Services
The Service may contain links to or integrate with third-party services (e.g., Stripe for payments). We are not responsible for the content, policies, or practices of third-party services. Your use of such services is at your own risk.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:
- Perform scheduled maintenance with reasonable notice
- Experience unplanned downtime due to technical issues
- Modify or discontinue features with notice
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, secure, or uninterrupted, or that defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKMENU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless QuickMenu and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for:
- Breach of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Extended inactivity
Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the country where QuickMenu is established, without regard to conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
